Intellectual property notice

1. Ownership
All intellectual property rights in and to the services, applications, platforms, websites, APIs, software (in both source code and object code form), AI models, machine learning systems, neural network architectures, model weights, training pipelines, inference engines, algorithms, knowledge graphs, ontologies, databases, data compilations, clinical reference content created by the Company, text, graphics, logos, trademarks, trade names, service marks, trade dress, user interfaces, visual designs, interaction designs, user experience designs, audio, video, computer code, product catalog design, marketplace design, Care Team Feed design and architecture, walk tracking algorithms and visualizations, metabolomics analysis pipelines, bioinformatics tools, documentation, specifications, and all other elements provided by or through Strand Health Inc., doing business as Everfur ("Company," "we," "us," or "our"), including but not limited to the Everfur Health Intelligence application, the Everfur Clinical Intelligence platform, the Care Team Feed, the Everfur Marketplace, and all related services (collectively, the "Services"), are and shall remain the sole and exclusive property of Strand Health Inc. and its licensors. The Services are protected by copyright, trademark, patent, trade secret, database rights, and other intellectual property and proprietary rights laws of the United States and international jurisdictions.
No license, right, title, or interest in any intellectual property is granted to you by implication, estoppel, exhaustion, or otherwise, except for the limited license expressly granted in our Terms of Service and End User License Agreement.
2. Trademarks
"Everfur," "Everfur Health Intelligence," "Everfur Clinical Intelligence," "Health Intelligence Pro," "Care Team Feed," "Everfur Marketplace," the Everfur logo, the Everfur wordmark, the Everfur icon, and all related names, logos, product and service names, designs, slogans, taglines, and trade dress are trademarks, service marks, or trade dress of Strand Health Inc. (collectively, "Company Marks"). You may not use Company Marks without our prior written permission, except as necessary to identify the Company in the context of nominative fair use.
Unauthorized use of our trademarks is strictly prohibited, including but not limited to: use in metatags, hidden text, SEO keywords, or source code; use in domain names, subdomains, social media account names, handles, or page names; use in a manner that is likely to cause confusion among consumers, dilute the distinctiveness of our marks, or tarnish, disparage, or discredit the Company or its Services; use in any manner that suggests endorsement, sponsorship, affiliation, or partnership with the Company without authorization; and use in conjunction with competing products or services.
All other names, logos, product and service names, designs, and slogans displayed through the Services (including those of product manufacturers, pharmacy partners, and other third parties in the Marketplace) are the trademarks of their respective owners and are used in the Services solely for identification and informational purposes. Their presence in the Services does not imply endorsement, sponsorship, or affiliation by or with the Company.
3. Copyright
All content available through the Services, including but not limited to text, editorial content, educational articles, graphics, photographs, images, illustrations, icons, audio clips, video clips, data compilations, software, AI generated content created using Company technology, product descriptions and imagery created by the Company, walk tracking visualizations, health report templates, Care Team Feed interface design, onboarding flows, marketing materials, and documentation, is the copyrighted property of Strand Health Inc. or its content suppliers and licensors. The compilation, arrangement, selection, and coordination of all content on the Services is the exclusive property of Strand Health Inc. and is protected by U.S. and international copyright laws, including protection under 17 U.S.C. Section 103 (compilations) and the Berne Convention.
You may not reproduce, distribute, publicly display, publicly perform, broadcast, transmit, modify, adapt, translate, prepare derivative works of, or otherwise exploit any Company created content from the Services without the express prior written consent of Strand Health Inc. or the applicable rights holder. This prohibition extends to: (a) systematic downloading, caching, crawling, or storage of any content; (b) framing, inline linking, or mirroring any part of the Services; (c) creating databases, datasets, or compilations from Services content; (d) reproduction of product catalog data, marketplace listings, AI output patterns, knowledge graph derived content, or drug interaction data; (e) training AI or ML systems on Services content; and (f) any use that exceeds the scope of the limited license granted in the Terms of Service.
4. Licensed Content
Certain clinical reference content, drug information, formulary data, clinical practice guidelines, pharmacokinetic databases, product descriptions and imagery from third party manufacturers, continuing education materials, and other materials displayed within the Services are used under license from third party publishers, content providers, product manufacturers, and academic institutions (collectively, "Licensed Content"). Licensed Content remains the property of the respective licensors and is protected by copyright and other intellectual property laws. Licensed Content may include materials from Wiley, Elsevier, and other veterinary and scientific publishers.
You may not: reproduce, copy, download, or duplicate any Licensed Content; distribute, sell, sublicense, rent, lease, or transfer Licensed Content; create derivative works, summaries, abstracts, or compilations based on Licensed Content; use Licensed Content for any purpose other than as part of your authorized use of the Services; systematically download, cache, spider, index, or store Licensed Content; remove or alter any copyright notices, watermarks, digital rights management identifiers, or attribution statements; or use Licensed Content to train, validate, or benchmark any AI or ML system.
5. User Generated Content
Content you post to the Care Team Feed, product reviews, comments, and other user generated content ("User Content") remains your intellectual property, subject to the license grant described in our Terms of Service (Section 5.4). By posting User Content, you represent and warrant that: (a) you own or have the necessary rights, licenses, and permissions to post such content; (b) the content does not infringe any third party intellectual property rights, including copyright, trademark, trade secret, patent, right of publicity, or right of privacy; (c) you have the consent of any identifiable individual appearing in the content; and (d) the content does not violate any applicable law.
If you believe that your intellectual property rights have been infringed by content posted by another user on the Care Team Feed, in product reviews, or elsewhere in the Services, please submit a notice as described in Section 7 (DMCA Procedures).
6. Proprietary Technology
6.1 AI Models and Algorithms
Our artificial intelligence models, machine learning algorithms, neural network architectures, model weights, model parameters, training methodologies, training data curation pipelines, feature engineering approaches, hyperparameter configurations, inference pipelines, inference optimization techniques, out of distribution detection systems, safety gate configurations, product recommendation engines, content moderation classifiers, knowledge graph reasoning engines, citation generation systems, audio analysis models, computer vision models, metabolomics analysis models, and all related AI/ML technologies are proprietary trade secrets and copyrighted works of authorship of Strand Health Inc. These technologies represent substantial investment in research, development, data curation, engineering, and scientific expertise. Any attempt to reverse engineer, extract, reconstruct, replicate, distill, approximate, or otherwise discover or reproduce these technologies is strictly prohibited and may result in civil and criminal liability.
6.2 Knowledge Graph
The Everfur veterinary knowledge graph, including its ontological structure, entity types, entity relationships, attribute schemas, evidence hierarchies, modifier taxonomies, drug interaction mappings, drug dosing algorithms, breed disease associations, symptom disease associations, diagnostic test associations, treatment protocol associations, laboratory reference ranges, and data compilation methodology, is a proprietary trade secret, copyrighted data compilation (protected under 17 U.S.C. Section 103), and database of Strand Health Inc. The knowledge graph represents substantial investment in scientific curation, veterinary expert review, computational modeling, and engineering.
6.3 Databases
All databases maintained by the Company, including drug databases, drug interaction databases, pharmacokinetic databases, breed databases, disease databases, clinical reference databases, product catalog databases, ingredient databases, user activity databases, walk pattern databases, feed content databases, and metabolomics reference databases, are proprietary data compilations protected by copyright law, trade secret law, and (where applicable) database protection laws.
6.4 Metabolomics Pipelines
The computational pipelines, bioinformatics algorithms, biomarker identification methods, metabolite quantification procedures, multivariate analysis frameworks, risk scoring models, reference population comparison methods, and analytical frameworks used in connection with the Everfur Fur Metabolomics Test Kit are proprietary trade secrets and copyrighted works of authorship of Strand Health Inc. and may be subject to pending or issued patents.
6.5 Platform Architecture
The technical architecture, system design, API design, API schema, data flow patterns, microservice architecture, security architecture, infrastructure configuration, deployment pipeline, monitoring infrastructure, and operational procedures of the Services are proprietary trade secrets.
6.6 AI Outputs
AI generated outputs (including health assessments, differential diagnoses, drug information, product recommendations, walk insights, and all other AI generated content) are generated using Company proprietary technology. To the extent such outputs contain creative or expressive elements attributable to the Company's AI systems, the Company asserts all available intellectual property rights therein. You are granted a limited license to use AI outputs for your personal, non commercial purposes (or internal business purposes for Clinical Intelligence users) as described in the Terms of Service. You may not commercially exploit, redistribute, publish, broadcast, or use AI outputs to train AI systems.
7. Digital Millennium Copyright Act (DMCA) Procedures
7.1 DMCA Takedown Notice
If you believe that any content available through the Services infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (17 U.S.C. Section 512) by providing the following information in writing to our designated copyright agent:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit the Company to locate the material (including, for Care Team Feed content, the URL, post identifier, or description of the post). Your contact information, including name, address, telephone number, and email address. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
7.2 Counter Notification
If you believe that content you posted was removed or disabled as a result of a mistaken or misidentified DMCA notification, you may submit a counter notification to our designated copyright agent containing: your physical or electronic signature; identification of the content that was removed and the location at which it appeared before removal; a statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification of the material; your full legal name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district courts in the Southern District of New York and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter notification, we will forward it to the complaining party and restore the removed content within ten (10) to fourteen (14) business days unless the complaining party notifies us that it has filed a court action seeking an order to restrain the alleged infringer from engaging in the infringing activity.

7.4 Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are found to be repeat infringers. A "repeat infringer" is a user against whom we have received more than two (2) valid DMCA notifications that have not been successfully countered.
8. Patents
Strand Health Inc. may hold or have pending patent applications covering various aspects of the Services, including but not limited to: AI powered clinical decision support systems for veterinary medicine; veterinary knowledge graph architectures, construction methods, and traversal algorithms; metabolomics based diagnostic and wellness assessment methods for companion animals using fur specimen analysis (with a non provisional patent filing targeted for September 2026); out of distribution detection systems for medical imaging in clinical AI applications; multi modal veterinary health intelligence systems combining text, image, audio, and structured data analysis; walk activity pattern analysis, pet wellness scoring, and activity trend detection methods; automated veterinary clinical note generation and structured data extraction from unstructured clinical text; and drug interaction detection and multi species pharmacogenomic alert systems.
This list is not exhaustive and additional patent applications may be pending or contemplated. Pending patent applications may or may not be published and may or may not result in issued patents. The Company reserves all rights to its patentable inventions.
Nothing in this notice or in the Services shall be construed as granting, by implication, estoppel, exhaustion, or otherwise, any license or right to use any patent owned or controlled by Strand Health Inc. Marking of patented articles, where applicable, is provided in accordance with 35 U.S.C. Section 287 (constructive notice via virtual patent marking at everfur.com/patents).
9. Trade Secret Protection
The following categories of information are considered trade secrets of Strand Health Inc. and are protected under the Defend Trade Secrets Act (18 U.S.C. Sections 1836 through 1839), the New York trade secret common law, and applicable state trade secret statutes (including the Uniform Trade Secrets Act as adopted in applicable jurisdictions):
AI model architectures, weights, hyperparameters, and training methodologies. Knowledge graph structure, content, curation methodology, and compilation methods. Proprietary data processing, analysis, and enrichment pipelines. Metabolomics analysis algorithms, biomarker identification methods, and reference population data. Product recommendation, personalization, and content ranking algorithms. Security architecture, threat models, vulnerability assessments, and incident response procedures. Business strategies, financial projections, pricing models, partnership terms, and customer lists. Non public performance metrics, accuracy data, model evaluation results, and benchmarking data. Annotation guidelines, data labeling methodologies, and quality assurance procedures. Internal documentation, product roadmaps, feature specifications, and technical architecture documents.
Any misappropriation of these trade secrets, whether by improper means (including theft, bribery, misrepresentation, breach of duty to maintain secrecy, or espionage) or by disclosure or use in breach of a confidentiality obligation, may result in civil liability (including actual damages, unjust enrichment, exemplary damages up to 2x actual damages for willful misappropriation, and attorneys' fees) and criminal liability (including fines and imprisonment under 18 U.S.C. Section 1832).
Pursuant to 18 U.S.C. Section 1833(b), an individual shall not be held criminally or civilly liable under any federal or state trade secret law for the disclosure of a trade secret that is made (a) in confidence to a federal, state, or local government official, or to an attorney, solely for the purpose of reporting or investigating a suspected violation of law, or (b) in a complaint or other document filed under seal in a lawsuit or other proceeding.
10. Reservation of Rights
All rights not expressly granted in our Terms of Service, End User License Agreement, or any other written agreement signed by an authorized representative of Strand Health Inc. are hereby reserved by Strand Health Inc. No license, right, title, or interest in any intellectual property is granted by implication, estoppel, exhaustion, or otherwise, except as expressly set forth in a written agreement.
11. International Intellectual Property Protections
Our intellectual property rights are protected under the laws of the United States and under applicable international treaties and conventions, including the Berne Convention for the Protection of Literary and Artistic Works, the Paris Convention for the Protection of Industrial Property, the Patent Cooperation Treaty (PCT), the Madrid Protocol for international trademark registration, the TRIPS Agreement (Agreement on Trade Related Aspects of Intellectual Property Rights), and applicable bilateral and multilateral intellectual property agreements. We actively monitor for and enforce against intellectual property infringement in all jurisdictions where we operate or where our intellectual property may be exploited.
To the extent applicable under the laws of the European Union, European Economic Area member states, the United Kingdom, and other jurisdictions that recognize database rights (sui generis database rights), we assert all available database rights in our databases, data compilations, and structured datasets, including the knowledge graph, drug databases, breed databases, and product catalog databases.
12. Trademark Usage Guidelines
Any authorized use of Company Marks (for example, by authorized resellers, integration partners, or media) must comply with our Trademark Usage Guidelines, which may be requested from legal@everfur.com. In general, authorized use requires: (a) use of Company Marks only in the form provided, without modification, alteration, abbreviation, or combination with other marks; (b) inclusion of the appropriate trademark notice (TM or (R) as designated); (c) acknowledgment that Strand Health Inc. is the owner of the mark; (d) avoidance of any use that implies endorsement, sponsorship, or affiliation beyond the authorized scope; and (e) immediate cessation of use upon request by the Company.
13. IP Warranty Disclaimer
THE COMPANY MAKES NO REPRESENTATION OR WARRANTY THAT THE SERVICES OR ANY CONTENT THEREIN DO NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO INTELLECTUAL PROPERTY, INCLUDING ANY WARRANTY OF NON INFRINGEMENT. IF YOU BECOME AWARE OF ANY ACTUAL OR POTENTIAL INTELLECTUAL PROPERTY INFRINGEMENT RELATED TO THE SERVICES, PLEASE NOTIFY US IMMEDIATELY AT LEGAL@EVERFUR.COM.
14. IP Infringement Claims Against the Company
If you believe that any aspect of the Services infringes your intellectual property rights (other than copyright claims addressed through DMCA procedures in Section 7), please contact us at legal@everfur.com with a detailed description of your claim, including: identification of the specific intellectual property right at issue (patent number, trademark registration number, or other identifying information); identification of the specific content, feature, or functionality you believe is infringing; a description of the basis for your claim, including how the allegedly infringing material meets each element of your intellectual property right; and your contact information. We will review all good faith intellectual property claims and respond within thirty (30) business days.
