Acceptable use policy

1. Purpose
This Acceptable Use Policy ("AUP" or "Policy") sets forth the rules and guidelines governing the use of the services, applications, platforms, APIs, and related products (collectively, the "Services") provided by Strand Health Inc., doing business as Everfur ("Company," "we," "us," or "our"). This AUP is incorporated by reference into our Terms of Service and applies to all users of the Services, including users of Everfur Health Intelligence and Everfur Clinical Intelligence.
By accessing or using the Services, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your access to the Services, and may subject you to legal liability.
2. Prohibited Uses
You agree not to use the Services for any of the following purposes:
2.1 Unlawful Activity
- Engaging in any activity that violates any applicable local, state, national, or international law, regulation, or ordinance.
- Facilitating, encouraging, or promoting any illegal activity.
- Practicing veterinary medicine without a valid license in the applicable jurisdiction.
- Prescribing, dispensing, or administering controlled substances in violation of DEA regulations or state pharmacy and veterinary practice acts.
2.2 Harm to Animals
- Using the Services as the sole basis for euthanasia decisions without independent veterinary evaluation and client consultation.
- Using the Services to facilitate animal abuse, neglect, or cruelty.
- Intentionally misusing the Services in a manner that results in or contributes to harm to any animal.
- Using the Services to prescribe or administer medications without establishing a valid veterinarian-client-patient relationship (VCPR) as required by applicable law.
2.3 Misuse of AI Outputs
- Representing AI-generated outputs as the professional opinion or recommendation of a licensed veterinarian, unless a licensed veterinarian has independently reviewed and adopted the output.
- Distributing, publishing, or publicly sharing AI-generated outputs in a manner that implies they constitute veterinary medical advice, diagnosis, or treatment.
- Using AI-generated outputs to make clinical decisions without appropriate professional review and verification.
- Systematically extracting, collecting, or harvesting AI-generated outputs for the purpose of creating competing datasets, knowledge bases, or AI models.
2.4 Intellectual Property Violations
- Copying, reproducing, distributing, modifying, or creating derivative works from any content, data, software, AI models, algorithms, or other materials provided through the Services.
- Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code, underlying algorithms, or knowledge graph structure of the Services.
- Removing, altering, or obscuring any copyright, trademark, or other proprietary rights notices from the Services.
- Using the Services to infringe upon the intellectual property rights of any third party.
- Redistributing licensed clinical content, drug information, or formulary data obtained through the Services.
2.5 Security Violations
- Attempting to gain unauthorized access to the Services, other user accounts, computer systems, or networks connected to the Services.
- Interfering with or disrupting the integrity or performance of the Services, including denial-of-service attacks, injection attacks, or buffer overflow attacks.
- Uploading or transmitting any malicious code, viruses, worms, Trojan horses, or other harmful software.
- Probing, scanning, or testing the vulnerability of any system or network without express written authorization.
- Circumventing any security measures, access controls, or usage limits implemented by the Company.
2.6 Data Misuse
- Collecting, harvesting, or scraping personal information of other users or any data from the Services using automated means.
- Sharing your account credentials with unauthorized third parties.
- Submitting false, misleading, or inaccurate information to the Services.
- Using the Services to send unsolicited commercial communications (spam).
- Using the Services to collect or store personal data about individuals without their knowledge and consent.
2.7 Competitive Use
- Using the Services to build, develop, train, or improve a product or service that competes with the Services.
- Using the Services to benchmark against competing products or services for the purpose of competitive analysis.
- Accessing the Services through the API for the purpose of replicating the functionality of the Services in a separate product.
3. Usage Limits and Fair Use
We may impose reasonable usage limits on the Services to ensure fair access for all users and to protect the integrity and performance of our systems. These limits may include restrictions on API call volumes, query frequency, data upload sizes, and concurrent connections. Usage limits applicable to your account or plan will be communicated through the Services or your enterprise agreement.
4. Reporting Violations
If you become aware of any violation of this AUP, please report it to us at legal@everfur.com. We take all reports seriously and will investigate promptly.
5. Enforcement
We reserve the right, in our sole discretion, to investigate any suspected violation of this AUP and to take appropriate action, including but not limited to:
- Issuing a warning to the user.
- Temporarily suspending access to the Services.
- Permanently terminating the user's account.
- Removing or disabling access to any content or data that violates this AUP.
- Reporting the violation to appropriate law enforcement authorities.
- Pursuing legal remedies, including injunctive relief and damages.
6. Modifications
We reserve the right to modify this AUP at any time. Changes will be effective upon posting to everfur.com/acceptable-use. Your continued use of the Services after any modification constitutes your acceptance of the modified AUP.
