Acceptable use policy

1. Purpose

This Acceptable Use Policy ("AUP" or "Policy") sets forth the rules and guidelines governing the use of the services, applications, platforms, APIs, e-commerce marketplace, community features, prescription coordination tools, walk tracking features, and related products (collectively, the "Services") provided by Strand Health Inc., doing business as Everfur ("Company," "we," "us," or "our"). This AUP is incorporated by reference into our Terms of Service and applies to all users of the Services, including registered account holders, trial users, beta testers, Care Team Feed participants, Marketplace customers, API consumers, and authorized enterprise users.

By accessing or using the Services, you agree to comply with this AUP in its entirety. Violation of this AUP may result in suspension or termination of your access to the Services, removal of your content, cancellation of pending orders, forfeiture of subscription credits, and may subject you to civil or criminal legal liability.

2. Prohibited Uses

2.1 Unlawful Activity

Engaging in any activity that violates any applicable federal, state, local, or international law, regulation, rule, or ordinance. Facilitating, encouraging, soliciting, or promoting any illegal activity. Practicing veterinary medicine without a valid license in the applicable jurisdiction. Prescribing, dispensing, compounding, or administering controlled substances in violation of applicable DEA, federal, or state regulations. Using prescription coordination features to obtain prescriptions fraudulently, to forge or alter prescriptions, or to circumvent prescribing requirements, quantity limits, or refill restrictions. Purchasing products through the Marketplace for illegal purposes, unauthorized resale, commercial distribution, or distribution of regulated products in violation of applicable law. Using the Services to engage in money laundering, terrorist financing, or sanctions evasion.

2.2 Harm to Animals

Using the Services as the sole basis for euthanasia decisions without independent veterinary evaluation. Using the Services to facilitate animal abuse, neglect, cruelty, abandonment, or animal fighting. Intentionally misusing the Services in a manner that results in or could reasonably be expected to result in harm to any animal. Using the Services to prescribe or administer medications without a valid VCPR. Purchasing products through the Marketplace and administering them in a manner inconsistent with veterinary guidance or label directions when professional consultation was warranted or required. Using walk tracking data to push animals beyond safe exercise limits or to exercise animals in dangerous conditions. Using the Care Team Feed to organize or promote animal fighting, puppy mills, or other forms of animal exploitation.

2.3 Misuse of AI Outputs

Representing AI generated outputs as the professional opinion of a licensed veterinarian, unless a licensed veterinarian has independently reviewed and adopted the output as their own professional opinion. Distributing or publishing AI outputs in a manner that implies they constitute veterinary medical advice, diagnosis, or treatment. Using AI outputs to make clinical decisions without appropriate professional review by a licensed veterinary professional. Systematically extracting AI outputs for the purpose of creating competing datasets, knowledge bases, training data, AI models, or clinical reference products. Representing AI generated product recommendations as veterinary prescriptions, professional endorsements, or clinical orders. Using AI outputs in legal proceedings, insurance claims, regulatory filings, malpractice defense, or other official proceedings without appropriate disclaimer and independent professional verification. Inputting deliberately false, misleading, or adversarial data to manipulate, bias, or exploit AI model outputs. Attempting to cause the AI to generate outputs that violate this AUP, including outputs that constitute the unauthorized practice of veterinary medicine.

2.4 Care Team Feed and Community Misuse

Posting content that is false, misleading, fabricated, or deceptive, particularly regarding animal health, medical treatments, drug dosing, product efficacy, or disease prevention. Impersonating a veterinary professional, veterinary technician, veterinary student, registered veterinary nurse, or other credentialed individual without holding the applicable license or credential. Posting content that promotes specific veterinary treatments, medications, dosing protocols, or surgical procedures as medical advice when you are not a licensed veterinary professional. Posting content that encourages, advises, or pressures other users to delay, avoid, or substitute professional veterinary care. Posting graphic, disturbing, gratuitously violent, or excessively graphic content depicting animal injury, suffering, or death, except in legitimate clinical educational contexts clearly identified as such and placed behind appropriate content warnings. Posting content that promotes animal abuse, neglect, fighting, cruelty, abandonment, or hoarding. Harassing, threatening, bullying, stalking, doxxing, or intimidating other users, whether publicly in the feed or through direct messages. Posting hate speech, discriminatory content, slurs, or content that targets individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or other protected characteristics. Posting spam, unsolicited promotional material, advertisements for third party products or services, affiliate links, multi level marketing content, or commercial solicitations. Soliciting other users for commercial purposes, financial gain, personal contact information, or offline meetings. Posting personally identifiable information (PII) of third parties without their express consent, including names, addresses, phone numbers, email addresses, photographs, or location information. Posting content that infringes any intellectual property right, including copyright, trademark, trade secret, or patent. Creating multiple accounts to evade community bans, usage limits, content moderation actions, or rate limits. Engaging in coordinated inauthentic behavior, including operating fake accounts, astroturfing, manipulating engagement metrics (likes, comments, shares), organizing brigading campaigns, or using automated tools to boost content visibility. Posting misinformation about veterinary diseases, outbreaks, zoonotic risks, or public health matters.

2.5 E-Commerce and Marketplace Misuse

Purchasing products for the purpose of unauthorized resale, commercial distribution, wholesale redistribution, or drop shipping. Submitting fraudulent payment information, initiating illegitimate chargebacks, or filing false dispute claims. Placing orders with no intent to complete the purchase or accept delivery. Exploiting pricing errors, promotional code glitches, referral program loopholes, or system vulnerabilities. Posting fraudulent, fake, misleading, or incentivized product reviews. Posting reviews that are unrelated to the product, contain personal attacks against other users or Company personnel, or include spam, promotional content, or competitor advertising. Purchasing products on behalf of others while misrepresenting the intended recipient or the purpose of the purchase. Attempting to purchase prescription or restricted products without valid authorization. Submitting false, exaggerated, or misleading information in connection with return, refund, or warranty requests. Using the Marketplace to engage in price manipulation, market manipulation, or anti competitive behavior.

2.6 Prescription Coordination Misuse

Submitting false, misleading, fabricated, or altered prescription information. Misrepresenting your identity, your relationship to an animal, or your authority to request prescription coordination. Requesting prescription coordination for controlled substances in violation of applicable DEA, federal, or state regulations, including attempting to obtain controlled substances without a legitimate veterinary medical purpose. Using prescription coordination features to circumvent prescribing requirements, quantity limits, formulary restrictions, or refill limitations. Sharing, transferring, selling, or redistributing prescription medications obtained through the Services. Using prescription coordination features on behalf of third parties without proper authorization from the animal's owner or legally authorized caretaker. Attempting to use prescription coordination features to fill prescriptions issued by veterinarians who have not established a valid VCPR. Stockpiling medications beyond reasonable quantities.

2.7 Intellectual Property Violations

Copying, reproducing, distributing, publicly displaying, publicly performing, modifying, adapting, translating, or creating derivative works from any content, data, software, AI models, algorithms, product descriptions, product imagery, brand assets, or other materials provided through the Services, except as expressly permitted in the Terms of Service. Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code, algorithms, model weights, knowledge graph structure, or trade secrets of the Services. Removing, altering, covering, or obscuring any proprietary rights notices, copyright notices, trademark notices, watermarks, or confidentiality legends. Using the Services to infringe upon the intellectual property rights of any third party, including uploading infringing content to the Care Team Feed. Redistributing licensed clinical content, drug information, formulary data, product catalog data, marketplace content, or other licensed materials. Scraping, crawling, indexing, harvesting, or systematically downloading content from the Care Team Feed, Marketplace, AI chat, or any other feature of the Services, whether by automated or manual means.

2.8 Security Violations

Attempting to gain unauthorized access to the Services, other user accounts, computer systems, networks, or databases. Interfering with or disrupting the integrity, performance, availability, or security of the Services or any connected systems. Uploading or transmitting malicious code, viruses, trojans, worms, ransomware, spyware, or other harmful software. Probing, scanning, or testing the vulnerability of any system or network without express written authorization from the Company's security team. Circumventing, bypassing, defeating, or disabling any security measures, access controls, rate limits, authentication mechanisms, or usage restrictions. Intercepting, monitoring, capturing, sniffing, or recording data transmitted between the Application and our servers or between users. Conducting denial of service attacks, distributed denial of service attacks, or any other action intended to degrade or disrupt the Services. Accessing or attempting to access the Services through any interface other than the interfaces we provide (mobile application, website, documented API).

2.9 Data Misuse

Collecting, scraping, harvesting, or aggregating personal information of other users. Sharing your account credentials with unauthorized third parties. Submitting false, misleading, or deliberately inaccurate information. Using the Services to send unsolicited bulk email, spam, or commercial communications. Collecting or storing personal data about individuals without their knowledge and consent. Downloading, copying, redistributing, republishing, or commercially exploiting other users' Care Team Feed content, photographs, personal information, or any other user generated content without the originating user's express consent. Using data obtained from the Services for purposes not authorized by the Terms of Service or this AUP.

2.10 Competitive Use

Using the Services to build, develop, train, or improve a competing product, service, AI model, dataset, or knowledge base. Using the Services to benchmark against competing products or services without our prior written consent. Accessing the Services through the API or any other means for the purpose of replicating, cloning, or reverse engineering functionality. Using product catalog data, pricing information, product descriptions, AI output patterns, knowledge graph content, or any other proprietary information to inform, develop, or improve a competing service. Engaging employees, contractors, or agents to use the Services for any purpose described in this Section 2.10.

3. Usage Limits and Fair Use

We may impose reasonable usage limits on the Services to ensure fair access, protect system integrity, and manage infrastructure costs. These limits may include restrictions on: API call volumes and rate limits; query frequency and complexity; data upload sizes; Care Team Feed post frequency and content volume; Marketplace order volume; walk tracking session duration and frequency; concurrent active sessions; image upload resolution and file size; audio recording duration; number of pet profiles per account; and any other usage metric we deem appropriate. Usage limits may vary by subscription tier. Abuse of usage limits or attempts to circumvent them through automated means, multiple accounts, API key rotation, or other techniques will be treated as a violation of this AUP.

4. Content Standards for User Generated Content

All content you submit to the Services, including Care Team Feed posts, product reviews, comments, reactions, images, audio, video, and other user generated content, must comply with this AUP and the following content standards:

Content must be truthful, accurate, and not materially misleading. Content must not infringe any third party intellectual property rights (copyright, trademark, trade secret, patent, or right of publicity). Content must not contain personal attacks, threats, intimidation, or harassment directed at any person. Content must be your own original creation or content you have the right and authority to share. Content must be appropriate for a general audience unless placed behind an appropriate content warning. Health related content must not be presented as veterinary medical advice unless you are a licensed veterinary professional providing advice within the scope of your license and VCPR. Content must not promote illegal activity, dangerous substances, or unsafe practices. Content must comply with all applicable laws and regulations.

5. Reporting Violations

If you become aware of any violation of this AUP, you may report it through the following channels: in app reporting feature (available on Care Team Feed posts, comments, product reviews, and user profiles); email to legal@everfur.com with a description of the violation and any supporting evidence; or through our website at everfur.com/report. We take all reports seriously and will investigate promptly. Reports may be submitted anonymously. We will not retaliate against users who report violations in good faith.

6. Enforcement

We reserve the right, in our sole discretion, to investigate any suspected violation and to take appropriate action, including but not limited to:

Issuing a warning with a description of the violation and instructions for corrective action. Temporarily suspending access to specific features or the entire Services. Permanently terminating the user's account and access to all Services. Removing, disabling, hiding, or restricting access to violating content. Cancelling pending Marketplace orders associated with violating activity. Refunding transactions obtained through violation of this AUP (at our discretion). Withholding refunds for transactions associated with violating activity. Reporting the violation to appropriate law enforcement authorities, including federal, state, and local authorities. Reporting prescription coordination abuse to applicable state veterinary boards, state boards of pharmacy, and the Drug Enforcement Administration (DEA). Reporting animal abuse or cruelty to applicable animal welfare authorities. Pursuing civil legal remedies, including injunctive relief, specific performance, and damages. Preserving evidence of violations for potential legal proceedings.

Enforcement actions may be taken without prior notice when we determine, in our sole discretion, that immediate action is necessary to protect the safety of users, animals, or the public, to comply with legal obligations, or to prevent ongoing harm.

7. Appeal Process

If you believe an enforcement action was taken in error, you may submit an appeal by emailing legal@everfur.com with the subject line "AUP Enforcement Appeal." Your appeal should include: a description of the enforcement action; an explanation of why you believe the action was in error; and any supporting evidence. We will review appeals and respond within fifteen (15) business days. Our decision on appeal is final.

8. Vulnerability Reporting Safe Harbor

We encourage responsible security research. If you discover a security vulnerability in the Services, please report it to security@everfur.com. We will not pursue legal action against individuals who: discover and report security vulnerabilities in good faith; do not exploit vulnerabilities beyond the minimum necessary to confirm their existence; do not access, modify, delete, or exfiltrate other users' data; do not degrade, disrupt, or impair the availability or performance of the Services; comply with our responsible disclosure guidelines (including providing us a reasonable period, not less than ninety (90) days, to remediate the vulnerability before public disclosure); and do not violate any applicable law. This safe harbor extends to civil claims under the Computer Fraud and Abuse Act (CFAA), the Digital Millennium Copyright Act (DMCA), and comparable state laws, provided the conditions above are met. This safe harbor does not extend to actions that violate the privacy of users, cause harm to users or their animals, or constitute criminal conduct beyond the scope of good faith security research.

9. Cooperation with Law Enforcement

We cooperate with law enforcement authorities in investigating suspected violations of law, including but not limited to: animal cruelty or abuse; controlled substance violations; fraud and financial crimes; harassment, stalking, or threats; intellectual property theft; and any other criminal activity. We may report suspected illegal activity to appropriate law enforcement authorities without prior notice to you. We may preserve and disclose information (including account data, usage data, IP addresses, and content) in response to lawful requests from law enforcement, including subpoenas, court orders, search warrants, and emergency disclosure requests. We will comply with all applicable legal process requirements and will seek to notify affected users of law enforcement requests where we are legally permitted to do so, unless prohibited by a court order, legal hold, or circumstances involving imminent risk of harm.

10. International User Obligations

If you access or use the Services from outside the United States, you are responsible for compliance with all applicable local laws, regulations, and customs. The Services are designed for and primarily operated in the United States. Drug information, prescribing practices, regulatory references, and product availability within the Services may not be applicable or lawful in your jurisdiction. You are prohibited from using the Services in any manner that would violate applicable export control, sanctions, or trade restriction laws. You assume all risk associated with using the Services from a jurisdiction outside the United States, including the risk that certain features, products, or information may not be lawful, available, or appropriate in your jurisdiction.

11. Age Verification

The Services are intended for users who are at least eighteen (18) years of age. By using the Services, you represent and warrant that you are at least eighteen (18) years of age. We do not knowingly allow individuals under eighteen (18) to create accounts, make purchases, post content, use prescription coordination features, or otherwise use the Services. If we become aware that a user is under eighteen (18), we will terminate their account and delete their data in accordance with our Data Deletion Policy and applicable child privacy laws.

12. No Obligation to Monitor

We have no obligation to monitor the Services for violations of this AUP, to review any user generated content before or after it is posted, or to pre screen content submitted by users. However, we reserve the right to do so at any time and to take enforcement action as described in Section 6. Our decision not to enforce a particular provision of this AUP at a given time does not constitute a waiver of our right to enforce that provision in the future.

13. Modifications

We reserve the right to modify this AUP at any time. Changes will be effective upon posting to everfur.com/acceptable-use with an updated effective date. Material changes will be communicated through the Services or via email. Your continued use of the Services after any modification constitutes your acceptance of the modified AUP.
